Bell of Ash Terms of Use

These are the same terms you accept in the Game before choosing a hero.

1. Who provides the Game

The game Bell of Ash (the “Game”) is provided by [IMIĘ I NAZWISKO ALBO NAZWA FIRMY], [ADRES]. For anything concerning the Game — questions, complaints, abuse reports and appeals against penalties — write to [ADRES E-MAIL]. These terms and the privacy policy are also on the Game's website: [ADRES STRONY]. These terms are an agreement between you and the creator of the Game; the app store you downloaded the Game from (Google Play or the App Store) is not a party to it and is not responsible for the Game or its content.

2. Accepting these terms and age

These terms set out the rules for using the Game. Starting the Game means you have read and accepted them; if you do not accept them, do not use the Game. The Game is intended for players aged 16 and over. If you are under 18, use the Game with your guardian's knowledge and make purchases only with their consent. You can read these terms again at any time in Options (“Terms and privacy”) and on the Game's website.

3. License

The creator grants you a non-exclusive, non-transferable license to use the Game for private, non-commercial purposes — on Apple-branded devices, on those you own or control, within the scope set by the Usage Rules of the Apple Media Services Terms and Conditions. The Game, its code, graphics, music, texts and names remain the property of the creator or the licensors (see the list of authors and licenses under “Credits”). The license must not be resold, rented out or passed on.

4. Account, progress and saves

The Game creates an account for you on its server the first time you enter the Camp — with no name, e-mail address or phone number. The account is recognised by a random identifier generated in the Game and stored on your device; there is no login and no password, so whoever holds that identifier has access to the account. Uninstalling the Game or clearing the app's data may cut you off from your progress for good, and we cannot move an account to another device. Progress — characters, items, gold, the Stash and achievements — is saved on your device and, when you use the online features, also on the server, whose record decides the state of the account. The creator is not responsible for data loss caused by device failure or by the user's actions.

5. Rules of play

It is forbidden to modify the Game's files, use cheating software or bots that play for you, tamper with saved progress or with the connection to the server, and exploit bugs in a way that harms the Game or other players. It is also forbidden to sell, buy or exchange accounts, characters and items for real money or outside the Game. Please report any bugs you find to [ADRES E-MAIL] — nobody is ever penalised for reporting one. Breaking these rules may lead to the account being muted, blocked temporarily or permanently, or deleted, and to items and currency obtained against the rules being taken back.

6. Chat and conduct towards other players

Chat in the Game — global, Order and private — is for talking about the Game. You must not insult, harass or threaten other players, post vulgar, hateful, sexual or violence-inciting content, spam or advertise, impersonate other people, phish for data or trade accounts outside the Game. There is zero tolerance for objectionable content and for abusive behaviour. Profanity is masked automatically, you can report any message with the “Report” button and silence an unwanted player for yourself with the “Block” button. Messages in global and Order chat are visible to other players — do not share personal data in them.

7. Moderation, penalties and appeals

We review chat reports and act within 24 hours at the latest. Content passes through an automatic filter that masks profanity from a word list; the decision to impose a penalty is made by a person, not by a machine. Penalties are graduated — from a warning through a mute and a temporary block to a permanent block and deletion of the account — and we match them to how serious and how repeated the breach is. You learn about a penalty in the Game together with its reason and its end date. If you believe a penalty is a mistake, write to [ADRES E-MAIL]: we reply within 14 days and lift any penalty imposed wrongly. A penalty for breaking these terms does not in itself entitle you to a refund for earlier purchases, which does not limit your statutory rights.

8. The Ash Bazaar and the Order

The Ash Bazaar is trading between players for in-game gold only. A listed item leaves your inventory immediately, a listing expires after 48 hours, and we take 10 per cent of the price of a completed sale; unsold goods and payments wait in the Ash Bazaar Chest until you collect them. We do not reverse a completed trade — check the price and the goods before you confirm. The Order is a voluntary group of players with its own chat and treasury; a contribution to the treasury cannot be withdrawn, and neither leaving the Order nor disbanding it returns it. Members of an Order are responsible for its content and conduct on the terms of sections 6 and 7.

9. Purchases in the Game

If purchases are enabled in the Game, real money can buy only Bell Tears — the Game's currency. Purchases give no advantage in combat: we do not sell items, stats, materials or random chests, and we do not sell draws with an uncertain outcome. The price in your currency is shown by the app store before you confirm the purchase, and the indicative prices shown in the Game may differ from it. Payment is handled solely by the store — Google Play or the App Store — under its own rules: it collects the payment, issues the receipt and handles refunds, and we neither receive nor store your payment details. Purchases are made by adults, and by minors only with a guardian's consent.

10. Bell Tears, cosmetics and the Season Pass

Bell Tears are digital content delivered to your account immediately after the store confirms the purchase. They have no monetary value, cannot be exchanged back for money or moved to another account, and do not expire with time — they are lost only when the account is deleted, including when you delete it yourself. Tears buy character looks and the Penitent's Path in the Season Pass; a purchased look stays on the account permanently. A season lasts 28 days: Season Pass rewards you do not collect before it ends are forfeited, and Season Pass progress then starts from zero. A Penitent's Path bought in a given season applies only to that season.

11. Withdrawal from the contract and complaints

By buying Bell Tears you agree to the digital content being delivered immediately, before the withdrawal period ends. Even so, for 14 days from the purchase you may withdraw from it as long as you have not spent the Tears you bought: file the refund request in the app store and we will support it. Once the Tears have been spent there is no right of withdrawal, because the content has been used in full. File a complaint about the Game or a purchase at [ADRES E-MAIL], describing what does not work — we reply within 14 days. The Game is meant to conform to the contract; if it does not, you have the rights given to you by the law on digital content. These terms do not limit the rights you have as a consumer under the law.

12. Updates, changes and closing the Game

The Game is a service that develops over time. We deliver updates — including ones downloaded automatically when the Game starts — and they are needed for the Game to work correctly and safely. Updates may change gameplay balance, in-game prices and the content of seasons, and may add and remove features; changes that matter to players are announced in the Game. We try to announce maintenance breaks in advance and to fix unannounced ones as quickly as possible. Should we have to close the Game or its online features for good, we will announce it in the Game at least 30 days beforehand.

13. Privacy

An account in the Game requires no name, e-mail address or phone number. On the server we keep what the online features require: character progress and the state of the economy, character names, Order membership, chat messages together with reports, Ash Bazaar listings and Chest, the friends list, weekly ranking results and receipts for purchases made in the app store. Your character's name together with its score is visible to other players in the weekly ranking. We never see payment details — payment is handled entirely by the store. Chat translation, when enabled in Options, sends the text of messages to a translation service running on the same server. The Game's server is located in Germany. You can delete your account together with the data on the server and the save on your device in Options (“Account” → “Delete account”) or through the website [ADRES STRONY]. You can keep playing without an internet connection — only the online features are unavailable then. The full rules on data processing and your rights are set out in the privacy policy on the Game's website.

14. Game content

The Game contains fantasy violence, a dark atmosphere and horror themes, as well as chat with other players, where content may appear that comes from them and not from the creator. The Game is intended for players aged 16 and over. The Game's content is fiction and does not refer to real people or events.

15. Health and safety

Take breaks during long play sessions. The Game contains flashes and screen shake — you can reduce them in Options (effects quality). People with light sensitivity should use caution.

16. Liability

The Game is provided as it is. The creator makes every effort to have it work correctly but does not guarantee that it is free of bugs, that the online features are continuously available, or that it runs on every device. We are not responsible for the consequences of other players' actions, of a failure of your device, of the loss of your account identifier, or for outages on the side of the app store or your internet provider. Nothing in these terms excludes or limits liability to the extent the law does not allow it, or the rights of a consumer.

17. Terms required by Apple

This section applies if you downloaded the Game from the App Store. These terms are concluded between you and the creator of the Game, not Apple, and the creator alone is responsible for the Game and its content. Maintenance and support for the Game are provided solely by the creator — Apple has no obligation whatsoever in that respect. If the Game fails to conform to any warranty given by the creator, you may notify Apple, and Apple will refund the purchase price of the Game; to the maximum extent permitted by law, Apple will have no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are the creator's responsibility. The creator, not Apple, is responsible for claims concerning the Game — including product liability, failure to conform to legal or regulatory requirements, and claims under consumer protection or data protection law. The creator is also responsible for the investigation, defence and settlement of any claim that the Game infringes a third party's intellectual property rights. By using the Game you represent that you are not located in a country subject to a United States Government embargo or designated by that Government as a terrorist supporting country, and that you are not listed on any United States Government list of prohibited or restricted parties. You undertake to comply with applicable third party terms when using the Game. Apple and Apple's subsidiaries are third party beneficiaries of these terms and, upon your acceptance of them, have the right to enforce them against you. The creator's name, address and contact details are given in section 1.

18. Changes to these terms

These terms may change as the Game develops and as the law changes. You will be informed of a change when the terms are shown again for acceptance as the Game starts, and the changed text will also appear on the Game's website. If you do not agree to a change, do not accept the terms and stop using the Game — you can then delete your account in Options. A change does not affect purchases made before it takes effect.

19. Governing law, disputes and contact

These terms are governed by Polish law, which does not deprive you of the protection given by the mandatory provisions of the country where you habitually reside. We try to settle disputes amicably — the simplest way is to write to [ADRES E-MAIL]. If that does not help, a consumer may use the out-of-court dispute resolution methods available in their country, for example a consumer ombudsman or a trading standards authority; the courts remain open as well.
